Terms of Service for BeThere

Welcome to BeThere ("BeThere," "we," "our," "us," or "Company"). These Terms of Service ("Terms") govern your access to and use of the BeThere mobile application, website, products, services, and related features (collectively, the "Platform").

By accessing or using BeThere, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the Platform.

1. Acceptance of Terms

By creating an account, accessing, or using BeThere, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you are using BeThere on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 18 years old to use BeThere. By using the Platform, you represent and warrant that you meet this age requirement.

Age Eligibility The Services are intended solely for individuals who are at least eighteen (18) years of age or the age of legal majority in their jurisdiction. By creating an account or using the Services, you represent and warrant that you are at least eighteen (18) years old and have the legal capacity to enter into these Terms. Individuals under the age of eighteen (18) are not permitted to create an account or use the Services. If BeThere becomes aware that an account has been created by a person under the required age, BeThere may suspend or permanently terminate the account without notice. BeThere reserves the right to request verification of age or identity at any time.

3. Account Registration

A. Account Creation

To use BeThere, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and password.

B. Account Security

You are solely responsible for:

Maintaining the confidentiality of your password
All activities that occur under your account
Notifying us immediately of any unauthorized use

C. Accurate Information

You agree to provide accurate, truthful, and complete information during registration and to keep this information updated.

4. User Conduct

You agree to use BeThere only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Platform.

Prohibited behavior includes:

Harassing, threatening, or abusing other users
Engaging in discriminatory or hateful conduct
Posting spam or unsolicited communications
Impersonating another person or entity
Attempting unauthorized access to the Platform
Distributing malware or harmful code
Violating intellectual property rights
Engaging in any illegal activity

5. Intellectual Property Rights

BeThere and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by BeThere, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you create and share on BeThere. By posting content, you grant BeThere a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content on the Platform.

6. User-Generated Content

You are responsible for any content you post, upload, or transmit through BeThere. You represent and warrant that:

You own or have the right to use the content
The content does not violate any laws or third-party rights
The content is accurate and not misleading

BeThere reserves the right to remove any content that violates these Terms or is otherwise objectionable.

7. Third-Party Integrations

BeThere may integrate with third-party services such as Google, Apple, Microsoft, LinkedIn, and others. Your use of these integrations is subject to the terms and privacy policies of those third parties.

BeThere is not responsible for the conduct, content, or policies of third-party services.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BETHERE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of the above limitations may not apply to you.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

BETHERE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify, defend, and hold harmless BeThere and its officers, directors, employees, agents, and successors from any claims, damages, losses, or expenses (including attorney's fees) arising out of your use of the Platform or violation of these Terms.

11. Termination

BeThere may terminate or suspend your account and access to the Platform at any time, for any reason, with or without notice, including if you violate these Terms.

Upon termination, your right to use the Platform immediately ceases.

12. Modifications to Terms

BeThere reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform.

Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration, except that either party may seek injunctive relief in court.

By agreeing to these Terms, you waive your right to a jury trial and class action.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BeThere regarding your use of the Platform and supersede all prior agreements and understandings.
